Common reasons beneficiaries aren't paid

The trustee is living in or controlling the trust house.

No accounting has been provided and calls go unanswered.

The trustee claims there is "nothing left" without proof.

Assets are being spent, hidden, or distributed unequally.

How we help you get paid

We demand a full accounting, push for distribution, and if needed petition the court to compel payment, surcharge the trustee, or remove them so a neutral trustee can finish the job.

Common questions

How long does a trustee have to distribute a trust in California?

California sets no single deadline, but trustees must administer the trust promptly and reasonably. Many trusts can be distributed within 12 to 18 months; unexplained delays beyond that may justify court action.

What can I do if the trustee won't pay my inheritance?

A beneficiary can demand an accounting and petition the probate court to compel distribution, surcharge the trustee for losses, or remove the trustee.

Can I get the trust accounting if the trustee refuses?

Yes. California Probate Code section 16062 generally requires trustees to account to beneficiaries, and the court can order one.
